This  site  presents the relevant data for the effort to incororate the area of San Martin into a rural town.    You will find information on the process of integration, how far it has come, and what is in store.  In addition links are provided to other sources of information including Santa Clara County sites and the San Martin Neighborhood Alliance.

PROPONENTS OF THE INCORPORATION

Proponents of the Incorporation of San Martin are the sponsors of the petition  supported by San Martin Neighborhood Alliance  (SMNA).

Law suit filed by SMNA against the Executive Offer of LAFCO and LAFCO

1.                  SMNA has made a request for State Controller?s review as an ?interested party? under the provisions of Gov. Code section 56801, seeking review of the Comprehensive Fiscal Analysis prepared in connection with the application for incorporation of San Martin. 

2.                  SMNA brings this lawsuit in two separate capacities.  One as proponent of the incorporation and the other as requestor of a State Controller?s review.

3.                  SMNA has completed all requirements necessary for a request for State Controller?s review under Gov. Code section 56801.  SMNA, as requestor, brings this suit to challenge the refusal of the Executive Officer of the Local Agency Formation Commission of Santa Clara County (?LAFCO?) to process its request for State Controller?s review under Gov. Code section 56801 and to enjoin the Executive Officer and the LAFCO Commissioners from interfering with the processing of the State Controller?s review.

4.                  In addition, the Executive Officer and LAFCO have chosen to deny the incorporation application without processing the State Controller?s review required by law.  They did so without legitimate governmental reasons, and in an arbitrary, subjective, and irrational manner.  Indeed, the refusal to process the State Controller?s review and the decision to terminate the application is simply a pretext or cover to delay or stop the incorporation process in order to prevent incorporation from going forward to a vote. 

5.                  SMNA also brings suit against LAFCO as the proponent for charging unreasonable fees for the incorporation which unreasonable fees put a chilling effect on the incorporation and are intended to impair or prevent SMNA, as proponent, from having the issue of incorporation brought to a vote.
